  • State opposes constitutional bail for Mundubile, Zulu and 16 others!

The State has opposed an application for constitutional bail by presidential candidate Brian Mundubile and his running mate Makebi Zulu, arguing that they pose a flight risk and could interfere with prosecution witnesses because of their political influence.

In an affidavit filed in the Lusaka High Court, the Director of Public Prosecutions (DPP) contends that the applicants should remain in detention due to the seriousness of the charges, the possibility of life imprisonment upon conviction and the complexity of ongoing investigations.

The State alleges that Mundubile and Zulu previously evaded arrest by seeking refuge at the United Nations House, forcing authorities to make special arrangements to secure their release into police custody.

“In casu, the first and second applicants present a genuine and imminent risk of flight,” the State submits.

Senior superintendent of police in charge of crime 1 in the Criminal Investigations Department, Donald Mulimba, who swore the affidavit in opposition, argues that the investigations involve extensive examination of digital forensic evidence and financial records, including inquiries that may extend beyond Zambia’s borders.

He stated that the continued detention of Mundubile, Zulu and 16 others, who are charged with treason and prohibition of terrorism, is necessary in the interests of public safety and national security.

The State further argues that Mundubile, Zulu and the 16 others should remain in detention because of the gravity of the alleged offences and the possibility of life imprisonment upon conviction.

On the question of delay, the state argues that the applicants have not demonstrated that the period spent in detention amounts to unreasonable or inordinate delay warranting constitutional bail.

It has cited the Supreme Court case of Shamwana and Others v The People, arguing that a period of seven months was considered reasonable when assessing delays in criminal proceedings.

The State has also relied on the Canadian Supreme Court decision in R v Morin (1992), which considered factors including the length of delay, reasons for the delay, institutional resource constraints and prejudice suffered by an accused person when determining whether a trial had been unreasonably delayed.

  • “My Daughter’s Lobola Should Be No Less Than K110,000. I Didn’t Send Her to School for Nothing!” 😂😭

    SİNGLE ENTRY

Name: Mr. Banda — Proud Father
    Daughter’s Age: 32
    Location: Lusaka
Status: Educated, single and ready for marriage — adv£rtisèd with her permission. 😂

Gentlemen, I am looking for a serious husband for my daughter.

I sent this girl to school, paid her fees, bought books, and made sure she graduated with a degree. Today, she is educated, beautiful and has only one child.

So please, don’t come here offering K15,000 and a bag of groceries. 😭😂

Her lobola should start at K110,000. I have invested too much in this project for someone to come and collect it on promotion!

I’m looking for a financially stable, mature man who is ready for marriage and understands responsibility.

And before you accuse me of s£lling my daughter, relax! 😂 She’s fully aware I’m adv£rtisìng her, and she has given me permission.

My daughter is looking for a husband. I am looking for a son-in-law who won’t ask me to help pay his wedding bills. 😭😂

Serious m£n only, please. If your bank account is still doing an internship, kindly wait until graduation.
